1. Introduction

These Terms of Use ("Terms") govern your access to and use of the 3DBerg website, platform, and manufacturing services provided by 3DBerg Ltd. ("3DBerg", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms.

2. Definitions

• "Platform" refers to the 3DBerg website and online quotation system
• "Services" refers to manufacturing, prototyping, and related services
• "User" refers to any individual or entity using our Platform or Services
• "Order" refers to a confirmed request for manufacturing services
• "Content" refers to CAD files, specifications, and other materials uploaded

3. Services Provided

3DBerg provides an on-demand manufacturing platform connecting users with verified manufacturing partners for CNC machining, 3D printing, sheet metal fabrication, and injection molding services. We facilitate the ordering process, quality control, and delivery of manufactured parts.

4. Order Process

Users may upload CAD files and request quotes through our Platform. Quotes are provided based on the specifications submitted. An Order is confirmed only upon acceptance of the quote and completion of payment. We reserve the right to decline orders that do not meet our manufacturing capabilities or quality standards.

5. Prices and Payment

All prices are quoted in the currency specified on the Platform. Prices include manufacturing costs but may exclude shipping, taxes, and customs duties. Payment terms are specified at checkout. We accept major credit cards and bank transfers for approved accounts.

6. Withdrawal and Refunds

Due to the custom nature of our manufacturing services, orders cannot be cancelled once production has begun. For orders not yet in production, cancellation requests will be reviewed on a case-by-case basis. Refunds may be issued for defective products or orders that do not meet agreed specifications.

7. Warranties and Claims

We warrant that manufactured parts will conform to the agreed specifications and tolerances. Claims for defects must be submitted within 14 days of delivery with photographic evidence. We will replace or refund defective parts at our discretion after verification.

8. Limitation of Liability

To the maximum extent permitted by law, 3DBerg shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid for the specific order giving rise to the claim.

9. Intellectual Property

You retain all intellectual property rights to your designs and CAD files. By uploading Content, you grant us a limited license to use it solely for manufacturing your order. We treat all customer designs as confidential and do not share them beyond what is necessary for production.

10. Prohibited Uses

You agree not to use our services to:

• Manufacture weapons, explosives, or illegal items
• Infringe on third-party intellectual property rights
• Upload malicious files or attempt to compromise our systems
• Misrepresent your identity or provide false information

11. Dispute Resolution

Any disputes arising from these Terms or your use of our services shall be governed by the laws of Bulgaria. We encourage resolution through direct communication. If a dispute cannot be resolved amicably, it shall be submitted to the competent courts of Sofia, Bulgaria.

12. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms on our website. Your continued use of our services after changes constitutes acceptance of the modified Terms.
